He was in Vegas playing the table on Superbowl weekend.
Nevada law bars casinos from allowing visibly drunk patrons to gamble and from serving them comped drinks.
The Grand is counter suing Johnston for trying to shirk his gambling debts.
The Nevada State Gaming Control Board is investigating.
